Just as fast as Facebook outpaced Myspace in the social media wars, technology has outpaced the law’s ability to come to grips with the protection of digital assets.

Estate planners have started to see more clients’ digital assets outlive them, and they’re now tasked with helping families manage that digital legacy. Challenges include the ownership, transfer and disposition of digital assets, ranging from passwords to web domains to financial accounts.

“There’s no paper trail anymore,” said Sharon Klein, Wilmington Trust’s managing director of family office services and wealth strategies, at a “Money and the Modern Family” press briefing last week in New York. “How does the executor get access to digital assets?”

The digital asset issue has become such a hot-button issue that seven states now have laws in place for estate planners and 13 other states have pending legislation, said Klein, who is based in New York and serves as chair of the New York City Bar’s Trusts, Estates and Surrogate’s Court Committee.

    But you can see in several places the consequences of the stampede toward high yield. Here are just a few:

    Closed-end funds Cornerstone Progressive (NYSEMKT: CFP  ) and Pimco High Income (NYSE: PHK  ) both make fixed payments back to fund shareholders on a monthly basis, and their distribution yields are truly extraordinary, at about 17% and 12%, respectively. Those dividends have enticed shareholders to pay $1.30 to $1.40 or more for each $1 of assets in the funds. Yet during most months, a substantial portion of those distribution payments has simply been a return of investor capital rather than true income from the funds' investments. A recent study discussed in The Wall Street Journal found that returns on a portfolio with a combined value and dividend-income strategy outperformed a strategy focused more exclusively on maximizing dividends by an average of 1.7 percentage points per year, a huge edge in long-run returns. In the dividend ETF arena, most funds tend to focus on maximizing yield. Although the popular Vanguard Dividend Appreciation (NYSEMKT: VIG  ) ETF bucks the trend by screening first for consistent dividend growth and only then looking at yield as a factor, many rival ETFs start with high-yielding stocks as their baseline and only then consider other desirable traits. Others focus solely on high-dividend niches of the market, such as iShares FTSE NAREIT Mortgage-Plus (NYSEMKT: REM  ) and its concentration on high-yield mortgage REITs.

    When dividend stocks get too popular, their prices get out of line with both their dividend income and the fundamentals of the businesses that underlie those stocks. In simpler terms, when dividend stocks become bad values, it's time to consider looking elsewhere for a margin of safety.

However, the stocks are illiquid and their free cash flow relative to the dollar value of freely traded shares is not high. As a result, I'm always in favor of RSKIA and ARKR buying back stock. But, I understand it's very hard for them to do in practice unless there is a meaningful holder who signals he wants out of the stock.

    My approach to buybacks is pretty simple. One, I prefer them. Two, I look at the share count history over the last 10 to 20 years as my guide to what the company might do in the future - I want a pattern of predictable behavior. Generally, that means a continuously shrinking share count that shrinks in bull markets and bear markets, panics and recessions and booms and busts and so on. Three, if I'm a buyer of the stock - then the company should be a buyer of its own stock. No questions asked on that one. If the stock is good enough for me to buy it's clearly good enough for the company to buy. Finally, I look for the return on buyback. I tend to focus on the earning power the company is buying relative to the net cash it is spending. If a company has cash on its balance sheet, the amount of net cash consumed by a buyback will be less than it appears because I will end up with a greater percentage ownership of the resulting balance sheet as well as the income statement.

    I want the return on buyback to always be at least 10%. As a rule, the average company will only get returns on its buybacks of 10% or higher if it pays less than 15 times normal earnings. In special cases - fast growing companies, companies where free cash flow vastly exceeds reported income, etc. - it is possible that buybacks above 15 times earnings will return more than 10%. It almost never makes sense for a company to buy back stock at over 25 times earnings. So, for most companies, under 15 times earnings is the green zone for buybacks - 15 to 25 times earnings is

    So far, we've seen some evidence that dividend-paying stocks are doing worse than the overall market since the latest pullback began. iShares S&P Global Energy Sector Index Fund (the Fund) seeks investment results that correspond generally to the price and yield performance of the Standard & Poor�� Global Energy Sector Index (the Index). The Index is a subset of the Standard & Poor�� Global 1200 Index, and measures the performance of companies that Standard & Poor�� deems to be part of the energy sector.     So far, 2014 has been a year of heightened geopolitical risk. Russia has annexed the Crimea region of Ukraine, Syria remains embroiled in a civil war, political protests continue in Egypt and Turkey, and North Korea has once again fired missiles into the sea to protest joint US-South Korea military exercises.

    Earlier this month, the managing director of the International Monetary Fund, Christine Lagarde, pointed to these simmering geopolitical tensions as an impediment to global economic growth.

    Geopolitical risk can affect a variety of asset classes, ranging from energy and gold to bonds and equities. In the energy space, Brent crude, essentially the equivalent of West Texas Intermediate (WTI), traded above $109 a barrel thanks to worries that Russia might make a play for more Ukrainian territory. While WTI also spiked, it finished the week essentially flat following a stronger than expected inventory report from the Energy Information Administration (EIA).

    Even as oil prices are on the rise, so is production. In the US, the EIA reports that crude production average 7.5 million barrels per day (BPD) last year, 1 million BPD over 2012 and the highest annual rate since 1989. The agency estimates that production should run about 8.5 million BPD this year and hit 9.6 million BPD next year, the highest level of production since 1970.

    The Organization of Petroleum Exporting Countries (OPEC), which produces about 40 percent of the world�� oil, is forecasting similar supply growth. This past January production rose by 28,000 BPD to 29.71 million BPD, largely thanks to increased production from Libya. Including America�� production increase, non-OPEC countries are expected to boost their supply by 1.29 million BPD to 55.43 million BPD.

    With consumption forecast to grow by about 1.3 million BPD in 2014, that leaves supply and demand in almost perfect balance, supporting strong oil prices even when and if the crisis in Ukraine abates.
